A critical part of MKS' strategy is our strong relationships with our supply chain. Communicating our standards is essential for effectively managing these relationships. As part of our responsible and sustainable sourcing strategy, we are committed to working in partnership with our suppliers to set clear expectations of how we expect to work with them and what we expect from them. Therefore, we have formalized and standardized our expectations of our suppliers as follows:
MKS' Supplier Code of Conduct provides standards and guidelines of conduct for all suppliers doing business with any MKS company worldwide. MKS' reputation is built on honesty, integrity, quality and trust. We therefore expect that our supply chain partners to conduct themselves in the same manner, regardless of local business practices or social customs. The Supplier Code of Conduct sets out the minimum standard of business behavior expected so that suppliers act in ways that are ethical, corporately responsible and aims to ensure compliance with applicable laws and regulations.
MKS is committed to identifying any of its suppliers who source Conflict Minerals from the Democratic Republic of the Congo (DRC) region from conflict sources. We expect our suppliers to partner with us in this endeavor regardless of whether they are subject to the Conflict Minerals Rule by providing us with all necessary declarations.
We also expect our suppliers to pass this requirement on to their supply chain if they do not source directly from smelters and determine the source of the Conflict Minerals. As reasonably practical for the size and scope of our business – as well as the applicable requirements of Section 1502 of the Dodd-Frank Act, which aims to prevent the use of minerals that directly or indirectly finance or benefit armed groups in the DRC or in adjoining countries (“conflict minerals”) – our due diligence process has been designed to conform generally with the framework in the OECD Due Diligence Guidance for Responsible Supply Chains of Minerals from Conflict-Affected and High-Risk Areas (OECD Guidance) and the related Supplements for gold and for tin, tantalum and tungsten.

These Workmanship Standard publications serve as a guideline and acceptance criteria for items manufactured and/or purchased by MKS Instruments.
